Union is Confident Election Results Will Be Thrown Out Upon Review by the National Labor Relations Board

CALEXICO, Calif. — After workers faced unprecedented levels of intimidation and harassment during which their employer repeatedly violated labor law, SEIU-United Healthcare Workers West (SEIU-UHW) stands in unwavering support of the caregivers at Innercare clinics who are striving to form their union. Despite their right to organize for better conditions for themselves and their patients, Innercare management has denied workers a free and fair election. In response, SEIU-UHW is contesting today’s election result and will file objections pertaining to Innercare’s illegal anti-union behavior and labor law violations.

Workers at Innercare clinics have faced unprecedented and illegal harassment and retaliation in trying to form their union with SEIU-UHW, resulting in more than 30 Unfair Labor Practice charges filed against Innercare with the National Labor Relations Board.

“Innercare workers deserve fair treatment and a free and fair union election, instead many were unjustly harassed, intimidated or fired for exercising their legal right to form a union,” said Javier Hernandez, a telehealth technician at Innercare Calexico clinic. “The fight for a just and equitable workplace at Innercare is far from over, and we are confident that justice will ultimately prevail.”

The election took place from July 11-26, covering approximately 500 frontline workers across 14 Innercare clinics in the Imperial and Coachella Valleys. Despite facing illegal anti-union efforts, including forced meetings with management, personal searches, unlawful terminations, intimidation, and the hiring of union busters, Innercare workers remain resolute and more committed than ever to winning a voice on the job.
